LAWSUITS FOR UNSAFE PRODUCTS CAN BE HARD CASES

Recently there has been a lot of publicity about a lawsuit in which a man sued the manufacturers of a motorcycle and a motorcycle seat, claiming he suffered a long-lasting painful erection (priapism) as the result of riding on a motorcycle that had a ridge-like seat.  Reportedly, the man claimed that the injury to his penis was caused by the seat, which he claimed was negligently designed, manufactured, and/or installed by the defendants.

 

When a person is injured by an unsafe product, he or she might have the right to assert claims against those who designed, manufactured, sold, or furnished the product.  This type of claim is often referred to as a “product liability” claim.  Critical issues in product liability cases usually include whether the product contains a defect that makes it unsafe for its intended use and whether that defect caused the injury.

 

To be successful, the person commencing a product liability lawsuit usually has to provide opinions from experts that support his or her claim.  These cases are often expensive to pursue and difficult to win.
